1. The agreement
These terms are a contract between you and [operating company, to be inserted on incorporation] ("we", "us"), the provider of the Your D.O.S.E mobile application and website (together, "the Service").
By creating an account or using the Service you accept these terms. If you do not accept them, do not use the Service.
Our Privacy Policy explains how we handle your data, and our Health Disclaimer explains the limits of the guidance we provide. Both form part of this agreement, and the Health Disclaimer is the most important document of the three — please read it.
2. Who can use Your D.O.S.E
You must be 18 or over. We check your date of birth when you register, and we will close any account we find belongs to someone younger.
You need your own account. Do not share your login, and do not let anyone else use the Service through it.
3. What Your D.O.S.E is — and is not
Your D.O.S.E provides general wellness and educational content: guided movement, breathwork, meditation and nutrition information, arranged into a personalised daily plan based on the answers you give us.
It is not medical advice, diagnosis or treatment, and it is not a substitute for care from a qualified healthcare professional. It is not a medical device within the meaning of Regulation (EU) 2017/745, and we hold ourselves to the test in the guidance on software qualification, MDCG 2019-11. Nothing in the Service is intended to diagnose, monitor, treat, cure or prevent any condition. Where you tell us about a wellness concern, we use that to exclude practices that may be unsuitable and to suggest gentler ones — never to treat the concern. Our full regulatory position is in the legal notice.
Our instructors are qualified to teach movement and wellness practices. They are not your doctor, physiotherapist or dietitian, and they do not know your medical history. Please read the Health Disclaimer in full before you practise.
4. Your account
You are responsible for:
- keeping your password confidential;
- everything that happens through your account;
- the accuracy of what you tell us — particularly your date of birth and the wellness information you enter, because your plan and its safety exclusions are built from it.
Tell us promptly if you think someone else has access to your account.
You can browse as a guest without an account. Guest access is limited, and a guest record can be lost if you sign out or reinstall the app. Create an account if you want your progress kept.
5. Free access and the trial
- Part of the Service is free to use with an account.
- New subscribers get a 7-day free trial of the full Service. We may change the trial length for future subscribers; the length you are offered is shown before you confirm.
- The trial is once per person. If you have had one before, subscribing again starts billing immediately.
- No card is charged during the trial. If you do not cancel before it ends, your subscription begins and the first payment is taken.
- We will not extend a trial you forgot to cancel, but see §9.
6. Subscriptions and payment
- Subscriptions are offered monthly or annually. The price and billing period are shown before you confirm and again on your receipt.
- Subscriptions renew automatically at the end of each period until you cancel.
- Payment is processed by Stripe, which acts as merchant of record for the sale. Your card details go to Stripe and never reach us. Stripe calculates and adds any VAT or sales tax due where you live.
- Prices shown may exclude tax; the total including tax is shown at checkout before you pay.
- If a payment fails, we will retry it. While a payment is outstanding your access may be limited until it succeeds.
- We may change prices. An increase will not affect the period you have already paid for, and we will give you notice before it applies to a renewal — you can cancel before it takes effect.
- Founding member pricing, where offered, is a discounted rate for early subscribers. It is limited in number and we will say so where it is offered.
7. Cancelling
You can cancel at any time, from the billing portal reachable in the app. There is no cancellation fee and you do not have to give a reason.
Cancelling stops the next renewal. It does not end your access immediately — you keep the full Service until the end of the period you have already paid for, and it then reverts to free access. Your account, your history and your progress remain unless you delete them.
8. Your right to withdraw
If you are a consumer in the EU or UK, you normally have 14 days to withdraw from a distance contract without giving a reason.
Because the Service is digital content supplied immediately, this right ends once supply has begun with your agreement. When you start a subscription you ask us to give you access straight away, and you acknowledge that you lose the right of withdrawal once we do.
In practice the free trial gives you more than the law requires: you have a full week of complete access before any money is taken, and cancelling during it costs nothing.
9. Refunds
- Payments are generally non-refundable, because you keep access for the period you paid for.
- We will refund a renewal you did not intend — for example a trial you meant to cancel, or an annual renewal you did not notice — if you contact us within 14 days of the charge and have not made significant use of the Service in that period. Just ask.
- If the Service is substantially unavailable for a prolonged period through our fault, tell us and we will refund or extend your subscription fairly.
- Nothing here limits refund rights you have under consumer law in your country.
10. Referrals
You may share your referral code. If someone joins using it, both of you may receive free days of the full Service as described in the app at the time.
- A code can be applied once per account, and you cannot apply your own.
- Rewards have no cash value and cannot be exchanged.
- We may withdraw rewards obtained through fake or duplicate accounts, or any other abuse of the programme.
- We may change or end the programme; rewards already granted will be honoured.
11. Acceptable use
Do not:
- copy, download, record, redistribute, publicly perform or resell our content;
- share your account, or use one account for several people;
- attempt to bypass payment, entitlement or safety features, or falsify session completion to obtain rewards;
- probe, scan, overload or attack the Service, or access it by automated means without our permission;
- reverse-engineer the Service except where the law expressly allows it;
- upload anything unlawful, abusive, or infringing someone else's rights — including as a profile photograph.
12. Our content and your content
All practices, videos, audio, text, cues, images, the D.O.S.E name and the logo belong to us or our licensors. Your subscription gives you a personal, non-transferable, non-exclusive right to access them for your own use, for as long as your subscription lasts. Nothing is sold to you.
Anything you put into the Service — your notes, your profile photograph — stays yours. You give us only the permission we need to operate the Service for you: to store it, and to show it back to you. We do not publish it, and no other user can see it.
13. Availability and changes
We aim to keep the Service running but we do not guarantee it will be uninterrupted or error-free. We may need to suspend it for maintenance, usually with notice.
We add, change and retire content and features over time. If we make a change that substantially reduces what you have paid for, you may cancel and we will refund the unused part of your period.
We may update these terms. If a change materially affects your rights we will tell you in the app or by email before it takes effect, and continuing to use the Service after that means you accept it. If you do not, you can cancel.
14. Suspension and termination
We may suspend or close your account if you breach these terms, if we are required to by law, or to protect the Service or other users. Where it is reasonable to do so, we will warn you first and give you a chance to put it right. If we close your account without cause, we will refund the unused part of your subscription.
You can close your account at any time from Profile → Delete account. Deletion is final after 14 days; during that time you can change your mind. Deleting your account does not by itself refund an unused subscription — cancel first if you want a refund considered under §9.
15. Liability
You practise at your own risk. You are responsible for deciding whether a practice is right for your body on a given day, for stopping if something hurts, and for getting medical advice before starting if you have any health concern. Please read the Health Disclaimer.
We provide the Service with reasonable care and skill. To the extent the law allows, we are not liable for indirect or consequential loss, or for loss of data, profit or opportunity. Where we are liable, our total liability is limited to the amount you paid us in the twelve months before the claim.
Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be limited. If you are a consumer, your statutory rights are unaffected.
16. Governing law
These terms are governed by [jurisdiction, to be confirmed on incorporation] law, and the courts there have jurisdiction.
If you are a consumer, this does not deprive you of the protection of the mandatory laws of the country where you live, and you may bring proceedings in your own courts.
